Mavado’s appeal set for March

THE appeal against an assault-related conviction and $100,000 fine by reggae artiste Mavado is scheduled to be heard next March.

The matter was slated to be heard in the Court of Appeal Monda but the artiste’s legal team requested that it be taken off the list and set for a date in March 2013.

The artiste, whose given name is David Brooks, was in May convicted in the Montego Bay Resident Magistrate’s Court for assault occasioning actual bodily harm and malicious destruction of property, stemming from an incident on the Belmont main road district in the parish in July last year.

He was fined $80,000 or six months on the assault charge and another $20,000 or six months for malicious destruction of property. Both sentences were to run concurrently.

Brooks’ attorney Martyn Thomas said then that there would be an appeal of the verdict as they did not think the resident magistrate took everything into consideration.

The attorney said the police made no attempts to find the others persons involved in the incident, despite their names and addresses being made available, among other things.

Evidence was led that on July 22, at about 7:00 pm, the complainant and his son were in a Toyota Camry along the Belmont main road when they came up on a long line of traffic and pulled off the road which was dug up.

It was heard that a man known as ‘Fat Eye Dwayne’ came to the driver’s door, opened it and slammed it then re-opened it and allegedly began assaulting the driver.

The court then heard that ‘Fat Eye Dwayne’ slapped the man in his face and kicked him in the groin.

According to the evidence, Brooks then drove up in a black Range Rover and told the complainant to move out of the way as he was not going to drive his vehicle over the stones but the complainant refused.

The court heard then that artiste used the wheel of his vehicle to squeeze the man between his car door and the car, causing swelling to his foot and a cut to his shoulder.
